Terms of Service
Last updated: 18 October 2026
Welcome to Famous Roses.
These Terms of Service explain the conditions that apply when you browse our website, place an order or purchase products from Famous Roses.
We aim to make shopping with us straightforward and transparent. As specialists in roses and garden plants, we recognise that our products are living plants with particular seasonal, packaging and care requirements.
These Terms should be read together with our Returns, Refunds and Famous Roses Guarantee Policy, our Shipping and Delivery information, and our Privacy and Cookie Policies.
Nothing in these Terms excludes or limits rights that you have under applicable consumer protection legislation.

Our online store is powered by Shopify, which provides the ecommerce infrastructure used to display products, process orders and support payments.
2. Scope of these Terms
These Terms apply to purchases made through our website and to your use of its content and services.
By placing an order, you agree to the contractual terms presented to you during the purchasing process, subject to applicable consumer protection laws.
Before completing your purchase, you should review the product details, quantities, delivery destination, applicable charges and any relevant seasonal delivery information.
The following documents provide additional information:
-
Our Cookie Policy, available through the website footer.
Where a specific policy provides more detailed conditions for a particular matter, those conditions should be read together with these Terms. No provision overrides mandatory statutory rights.
If you purchase on behalf of a business rather than as a consumer, certain consumer-specific protections may not apply. Any separately agreed business terms will be confirmed before the relevant purchase.
3. Our products
Famous Roses sells roses, garden plants and related gardening products.
We make reasonable efforts to ensure that product descriptions, photographs and technical information are accurate and useful.
Living plants and natural variation
Roses and other garden plants are living products. Their appearance may vary naturally depending on the season, age, growing conditions and stage of development.
For example:
-
Bare-root roses may arrive dormant and without leaves.
-
Potted roses may be supplied at different stages of growth.
-
Flowering times, plant height and mature spread may vary with climate, soil, pruning and care.
-
Flower colour and appearance may show natural variations, and photographs may be affected by lighting and screen settings.
These natural characteristics do not remove our obligation to supply products that conform to their descriptions and applicable legal requirements.
We guarantee that the roses supplied correspond to the variety ordered, subject to the provisions of our Returns, Refunds and Famous Roses Guarantee Policy.
Planting and care information
We provide planting and care information to help customers give their roses the best possible start.
Customers are encouraged to follow suitable planting, watering and maintenance practices. However, failure to follow a recommendation does not automatically remove statutory rights in respect of goods that were already defective or non-conforming when supplied.
4. Product availability
Our rose varieties may be available in limited quantities.
Availability can vary depending on nursery production, seasonal supply, plant quality and customer demand.
Products may be described as available, available for advance order or currently out of stock.
We reserve the right to discontinue products or adjust the range offered on our website.
We may also limit order quantities where reasonably necessary, for example because of limited stock, delivery restrictions or suspected fraudulent purchasing activity.
If a product becomes unavailable after an order has been placed, we will contact you and explain the available options.
These may include:
-
Waiting for the original variety, where you agree to a revised delivery date.
-
Choosing an alternative product with your agreement.
-
Cancelling the affected product and receiving a refund.
We will not substitute a different rose variety without your agreement.
Any refund required because we cannot fulfil an accepted order will be made without undue delay and in accordance with applicable law.
5. Placing an order
To place an online order, select your products, add them to your basket and follow the checkout instructions.
You are responsible for checking that the information you provide is accurate, particularly:
-
The products and quantities ordered.
-
Your name and contact details.
-
Your delivery address and country.
-
Any relevant delivery instructions.
Before confirming an order, you will be shown the applicable prices, delivery charges and total amount payable.
Placing an order through the checkout involves an obligation to pay the amount clearly displayed before confirmation.
We will send an order acknowledgement or confirmation using the contact details supplied.
The conclusion and acceptance of the sales contract are governed by the information presented at checkout and applicable law.
If we identify a material problem with an order, such as an unavailable product, an incorrect delivery destination or an obvious pricing error, we will contact you to resolve it.
We will not make a material change to an accepted order without your agreement unless permitted by applicable law.
Where we cannot fulfil an order and cancellation is necessary, any payment already collected for the cancelled items will be refunded in accordance with the law.
6. Prices, promotions and payments
Product prices are displayed in the currency applicable to the selected storefront or market.
The total payable amount, including applicable taxes and any delivery charges, will be presented before you confirm your purchase, in accordance with applicable law.
Delivery charges may differ depending on the destination, product type, order size or delivery method.
For current delivery rates and conditions, please consult our Shipping and Delivery page.
Promotions and discounts
Famous Roses may offer:
-
Public promotional discounts.
-
Discounts for larger orders.
-
Offers for new customers.
-
Preferential discounts for returning customers.
-
Other temporary or seasonal promotions.
Each offer is subject to the eligibility criteria and conditions communicated when the offer is made.
Discounts are not necessarily cumulative unless expressly stated.
Eligibility for customer discounts is independent of newsletter subscription. You do not need to subscribe to marketing emails to qualify for a discount that is otherwise available to you.
Payment
Available payment methods are displayed during checkout.
Payments are processed through Shopify and/or supported payment service providers.
We do not require customers to provide complete payment card details directly to our customer service team.
Payment processing is subject to the security requirements and applicable terms of the relevant payment provider.
Prices and promotions may change for future orders. Any change to an already accepted order will be handled in accordance with applicable law and the terms agreed at purchase.
7. Delivery and seasonal fulfilment
Roses are living plants, and delivery is organised with consideration for suitable planting seasons and safe transport conditions.
Bare-root roses and potted roses may have different delivery periods.
Some products may be ordered in advance for delivery during a future planting season.
Where a specific future delivery period is agreed as part of your order, that period forms part of the agreed delivery arrangements.
Current information about delivery periods, destinations, charges and packaging is published on our Shipping and Delivery page.
Delivery arrangements
We use courier services and suitable packaging to protect plants during transport.
We may contact you to coordinate delivery where necessary.
Please ensure that the delivery information provided is correct and that reasonable arrangements can be made to receive the goods.
Delays
Occasionally, delivery may be affected by weather, plant readiness, transport disruption or other circumstances.
If an agreed delivery date or period cannot be met, we will inform you and, where appropriate, propose a revised arrangement.
Your rights in relation to late delivery remain governed by applicable law.
Unless another delivery period has been agreed, the statutory rules on delivery times apply.
Where a delivery is not completed within the agreed or legally required time, you may exercise the remedies available under applicable consumer protection legislation, including cancellation and reimbursement where the relevant conditions are met.
Responsibility during transport
Where delivery is arranged through a courier selected by Famous Roses, responsibility for loss or damage during transport remains with us until the goods are delivered to you or to a person you have designated to receive them, in accordance with applicable law.
Different rules may apply if you independently arrange collection by a carrier not offered by us.
8. Cancelling an order and changing your mind
Customers who purchase online may have a statutory right to withdraw from their purchase without giving a reason.
For EU consumers, this generally includes a 14-calendar-day withdrawal period after receipt of the goods, subject to applicable statutory conditions and exceptions.
Famous Roses also offers an additional voluntary return period of 30 calendar days from delivery, subject to the conditions of that commercial offer.
The two arrangements are separate and have different conditions.
Our Returns, Refunds and Famous Roses Guarantee Policy explains:
-
How to exercise your statutory right of withdrawal.
-
How to return products.
-
Which return delivery costs may be payable by the customer.
-
How refunds are calculated and processed.
-
The conditions of our additional voluntary return offer.
We do not exclude the statutory right of withdrawal merely because the product is a living plant.
If you wish to cancel or amend an order before dispatch, please contact us as soon as possible at info@famousroses.eu.
We will consider the request in light of the order status, the agreed delivery arrangements and your applicable rights.
9. Product quality and statutory consumer rights
We aim to deliver healthy, high-quality plants that correspond to the varieties and descriptions ordered.
If a product is faulty, damaged or does not conform to the contract, you may have statutory rights to appropriate remedies.
These rights are separate from any voluntary commercial guarantee offered by Famous Roses.
Depending on the circumstances and applicable law, statutory remedies may include replacement, a proportionate reduction in price or a refund. Where a defect can reasonably be corrected, repair may also be available.
All statutory remedies will be provided free of charge where required by law, including necessary transport costs. Nothing in these Terms limits your statutory consumer rights.
We may offer a refund as our preferred first solution, but this does not remove a customer's statutory entitlement to replacement or another remedy where applicable.
Nothing in these Terms reduces the duration or scope of mandatory legal guarantees.
Full information is available in our Returns, Refunds and Famous Roses Guarantee Policy.
10. Our six-month Growth and Variety Guarantee
In addition to statutory consumer protections, Famous Roses provides a six-calendar-month commercial Growth and Variety Guarantee, starting from the date you receive your plants.
This additional guarantee is intended to support customers if a plant fails to establish despite appropriate planting and care or if a problem concerning the supplied variety is identified.
For accepted growth claims, customers may choose a replacement plant or a refund of the affected plant's purchase price, subject to the conditions of the commercial guarantee.
Under this voluntary growth guarantee, a replacement plant is provided free of charge, while its delivery costs are payable by the customer.
This delivery-charge condition does not apply where the customer has a statutory right to a remedy free of charge.
Variety discrepancies are handled separately, with the appropriate remedies and without necessary return or replacement delivery charges to the customer.
For the full conditions, including the information required to support a claim, replacement availability and exclusions, please consult our Returns, Refunds and Famous Roses Guarantee Policy.
Our commercial guarantee never replaces or restricts statutory consumer rights.
11. Damaged, faulty or incorrectly supplied goods
If you receive goods that are damaged, faulty or different from those ordered, please contact info@famousroses.eu as soon as reasonably possible.
Include your order number and, where available, photographs showing the issue.
We recommend reporting visible transport damage promptly, preferably within 24 hours, to help us assess and resolve the matter efficiently.
This is a recommendation, not a mandatory deadline. Failure to report within 24 hours does not remove your statutory rights.
We will assess the circumstances and explain the appropriate solution.
For accepted claims, our preferred first solution is a refund of the affected goods. Replacement remains available where required by statutory consumer rights.
Where a return is necessary as part of a statutory remedy, we will cover the applicable necessary return costs.
Please refer to Section 4 of our Returns, Refunds and Famous Roses Guarantee Policy for complete details.
12. Customer accounts and personal information
You may be able to place orders with or without creating a customer account, depending on the checkout options available.
If you create an account, you are responsible for keeping your login details secure and for providing accurate account information.
Please notify us if you suspect unauthorised access to your account.
We process personal information in accordance with applicable data protection legislation, including the GDPR where relevant.
Our Privacy Policy explains how personal information is collected, used, retained and protected, including information about your rights.
Marketing communications
We send promotional emails and newsletters only to individuals who have subscribed.
Placing an order or creating an account does not automatically subscribe you to marketing communications.
You may unsubscribe from promotional emails at any time.
Cookies
Our website uses cookies and similar technologies for purposes including essential site operation and, where permitted, analytics and other functions.
Further information is provided in our Cookie Policy and consent controls.
13. Website content and intellectual property
Unless otherwise indicated, the content of this website, including photographs, text, product descriptions, visual designs, graphics and branding, belongs to Famous Roses or is used with permission from the relevant rights holders.
You may browse the website and use its content for personal, non-commercial purposes.
You may not reproduce, republish or commercially exploit protected website content without permission, except where permitted by law.
Third-party trademarks, breeders' rights, plant variety denominations and other protected material remain the property of their respective owners.
Nothing in these Terms transfers intellectual property rights to website visitors or customers.
14. Customer reviews and contributions
Customers may be invited to submit product reviews, photographs or feedback.
Reviews should reflect genuine experiences and must not contain unlawful, misleading, abusive or infringing material.
We may moderate contributions where reasonably necessary to comply with legal requirements, prevent misuse or maintain the integrity of the review system.
We will not remove a review merely because it expresses a negative but genuine customer experience.
Where you submit content specifically for public display, you grant Famous Roses permission to display and reproduce that content for the purpose for which it was submitted, subject to applicable intellectual property and data protection laws.
Private customer correspondence is not automatically treated as permission to publish personal information or use photographs in marketing materials.
15. Website operation and third-party services
We make reasonable efforts to keep our website accessible, accurate and secure.
However, temporary interruptions may occur because of maintenance, technical problems, security incidents or third-party service disruptions.
We may update or improve website features when reasonably necessary.
Where our website provides links to third-party resources or services, those resources may be subject to their own terms and privacy practices.
We are not responsible for independently operated third-party websites simply because we provide a link to them.
This does not exclude our responsibility for services or obligations that we are legally required to provide.
16. Limitation of liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
In particular, these Terms do not restrict:
-
Your statutory rights as a consumer.
-
Our responsibility for supplying goods that conform to the contract.
-
Our obligations concerning refunds, replacements or other mandatory consumer remedies.
-
Liability for fraud, intentional wrongdoing or other matters for which liability cannot lawfully be excluded.
-
Liability for death or personal injury caused by negligence, where applicable.
We are not responsible for losses arising solely from circumstances outside our reasonable control where the law permits such a limitation.
We cannot guarantee particular gardening results where plant performance depends on factors outside our control, including unsuitable growing conditions or improper care.
However, this does not affect our obligations concerning the quality, identity and conformity of plants supplied.
Any limitation of liability applies only to the extent permitted by applicable law.
17. Events beyond our reasonable control
Occasionally, circumstances beyond our reasonable control may interfere with our ability to fulfil an order.
Examples may include severe weather, natural disasters, major transport disruption, government restrictions or other exceptional events.
Where such circumstances affect fulfilment, we will take reasonable steps to minimise disruption and communicate with affected customers.
We may propose an alternative delivery arrangement where appropriate.
Such circumstances do not automatically entitle us to retain payment indefinitely or remove your rights regarding delayed or undelivered goods.
Any cancellation, refund or other remedy will be handled in accordance with applicable law.
18. Customer complaints and dispute resolution
We aim to resolve customer enquiries and complaints fairly and efficiently.
If you have a concern about an order, delivery, product or service, please contact us first at:
Please include your order number and a description of the issue, together with any relevant supporting information.
We will review your concern and normally aim to provide an initial response within seven calendar days.
Complex matters, including those requiring horticultural assessment or courier investigation, may take longer to resolve. We will keep you informed where appropriate.
If a disagreement cannot be resolved directly, you may seek assistance from the competent consumer protection authority or an appropriate alternative dispute resolution body.
In Romania, the National Authority for Consumer Protection (ANPC) provides information about consumer rights and alternative dispute resolution:
Alternative Dispute Resolution (SAL)
You may also have access to consumer protection authorities, European Consumer Centres or other remedies in your country of residence.
Nothing in these Terms prevents you from exercising your right to bring a claim before a competent court or pursuing another remedy available under applicable law.
19. Applicable law
These Terms are governed by Romanian law, subject to mandatory consumer protection provisions that apply to customers in other jurisdictions.
Where we direct commercial activities to consumers in another country, this choice of law does not deprive them of mandatory protections available under the law applicable to their consumer contract.
Any dispute concerning a consumer purchase will be subject to the jurisdiction rules applicable to that consumer, including relevant European Union provisions.
Nothing in these Terms requires consumers to waive rights or accept a court jurisdiction that cannot lawfully be imposed on them.
20. Changes to these Terms
We may update these Terms to reflect changes in legislation, business operations, services or website functionality.
The current version will be published on our website with its last-updated date.
Material changes will be communicated where required by law.
Changes to these Terms do not retrospectively alter the contractual rights and obligations applicable to orders already accepted, unless the law permits this or the parties agree otherwise.
If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
